BY ACCESSING OR PARTICIPATING IN THE ITEM INSTOCK MEETUP BETA PROGRAM (“MEETUP BETA”), YOU AGREE TO BE BOUND BY THESE TERMS, THE ITEM INSTOCK TERMS OF SERVICE, PRIVACY POLICY, AND ALL POLICIES INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE, YOU MUST NOT PARTICIPATE IN THE MEETUP BETA.

The Item Instock Meetup Beta is an optional feature that allows buyers and vendors on Item Instock (“Item Instock,” “we,” “us,” or “our”) to arrange in-person meetups to complete a transaction outside the standard Item Instock online checkout process. These Meetup Beta Terms supplement, and do not replace, the Item Instock Terms of Service. In the event of any conflict, the Item Instock Terms of Service shall control.

Participation in the Meetup Beta is voluntary. You must be at least 18 years old, have an Item Instock account in good standing, and reside in an eligible location where the Meetup Beta is available. Location information is approximate and may be determined using user-provided address details or IP-based data. Item Instock does not use precise GPS tracking.

Either the buyer or the vendor may accept or decline a meetup invitation at any time. There is no obligation to complete a transaction in person. If a meetup invitation is declined, the parties may still proceed with a standard online Item Instock transaction.

Meetup Beta transactions may involve payments made outside the Item Instock platform, including cash or other mutually agreed payment methods. Item Instock is not a party to offline transactions and does not process, hold, verify, or guarantee such payments. As a result, Item Instock cannot assist with refunds, returns, disputes, chargebacks, or payment issues arising from Meetup Beta transactions.

Solely in connection with Meetup Beta transactions, certain restrictions under the Item Instock Prohibited Conduct Policy may not apply, including proposing in-person transactions, discussing or completing payments outside the platform, or sharing limited personal information necessary to facilitate a meetup. All other platform rules and policies continue to apply to non-meetup transactions.

Meetup Beta transactions are not covered by Item Instock Buyer Protection, Seller Protection, Refunds and Returns, shipping protection, or dispute resolution services. Buyers are responsible for inspecting items before completing the transaction, and any dispute related to a Meetup Beta transaction is strictly between the buyer and the vendor.

YOU ACKNOWLEDGE AND AGREE THAT INTERACTING WITH OTHER USERS AND MEETING IN PERSON CARRIES INHERENT RISKS. ITEM INSTOCK DOES NOT VERIFY USER BACKGROUNDS OR CONDUCT BEYOND PLATFORM REQUIREMENTS. ANY PERSONAL INFORMATION YOU SHARE WITH ANOTHER USER IS PROVIDED VOLUNTARILY AND AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR TAKING ALL NECESSARY PRECAUTIONS WHEN ENGAGING IN OFFLINE OR IN-PERSON TRANSACTIONS.

Item Instock reserves the right, at its sole discretion and without prior notice, to modify, suspend, or discontinue the Meetup Beta program, or to suspend or terminate your participation if your account is not in good standing or if your actions are unauthorized, abusive, deceptive, fraudulent, or unlawful. Continued participation after any update constitutes acceptance of the revised terms.

Item Instock is committed to protecting intellectual property rights and maintaining a trusted marketplace for vendors and customers. Our Terms of Service prohibit listings or content that violate intellectual property rights, including copyright and trademark. Item Instock reserves the right to remove listings, suspend accounts, or restrict access where violations are identified, and to take action against repeated or bad-faith abuse of this policy.

Copyright
Copyright protects original works of authorship such as videos, music, books, software content, images, and written materials. It generally protects original expression (text, visuals, media) but does not protect names, titles, or slogans. Those elements may instead be protected under trademark law.

Trademark
A trademark is a word, name, slogan, symbol, or design—such as a brand name or logo—used to distinguish goods or services. Trademark law exists to prevent customer confusion regarding the source, affiliation, or endorsement of products sold on Item Instock.

Reporting Intellectual Property Infringement
Item Instock responds promptly to valid intellectual property infringement reports. When reported content is removed or access is disabled, we make reasonable efforts to notify the affected seller, explain the reason for removal, and provide guidance on next steps. In copyright-related cases, information on submitting a counter notice will be shared where applicable.

Item Instock may share the details of an infringement report, including the reporting party’s name and contact information, with the affected user to support transparent resolution.

Additional Review Requirements
To process a report, Item Instock may request supporting documentation such as proof of ownership, authorization letters, or identity verification. Reports or counter notices that are incomplete, misleading, fraudulent, or submitted in bad faith may be rejected. Item Instock reserves the right to take action against abuse of this policy.

Valid Reasons to Report a Listing
• Listings that infringe copyright or trademark rights
• Counterfeit or replica items
• Unauthorized use of copyrighted images, videos, or text

Invalid Reasons to Report a Listing
• Attempts to control resale channels or authorized sellers only
• Enforcing minimum advertised pricing (MAP)
• Contractual resale restrictions between brands and sellers
• Regulatory or government-controlled sales restrictions

Why a Listing Was Removed
If a listing is removed due to an intellectual property report, the seller will receive a notification explaining the action taken. Sellers are encouraged to contact the rights owner directly for clarification. Sellers remain responsible for ensuring all listed items are authentic and non-infringing.

Examples of Infringement
• Unauthorized use of a brand logo or trademark
• Sale of counterfeit goods
• Unauthorized copies of audio, video, or digital media
• Using a rights owner’s images or text without permission

Counter Notices
Item Instock accepts counter notices for copyright claims in accordance with applicable digital copyright laws. Upon receipt, a copy may be shared with the original reporting party. Removed content may be restored after the required review period unless legal action is initiated by the rights owner.

Repeat Infringement
Users with multiple confirmed intellectual property violations may have their selling privileges restricted or terminated. Attempts to bypass enforcement by creating new accounts may result in permanent denial of services across all related accounts.

Withdrawals
Only the original rights owner or authorized representative may formally withdraw an infringement report. Withdrawals must clearly identify the affected listing or user. Each case is reviewed individually, and withdrawals do not automatically reinstate listings or account privileges.
