These Terms of Service (“Terms”) govern your access to and use of the Item Instock platform, including our website, mobile applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be legally bound by these Terms, our Privacy Policy, and all referenced policies available in the Item Instock Help Center.

Item Instock is a consumer-focused online marketplace that connects independent sellers and buyers. Item Instock does not own, inspect, store, or sell listed items. All transactions are conducted directly between users, and users are solely responsible for listings, pricing, fulfillment, warranties, and compliance with applicable laws.

To access most features, you must create an Item Instock account. You must be at least 18 years old and provide accurate, current information. Only one account is permitted per individual or legal entity. Item Instock may suspend, limit, or terminate accounts that violate these Terms, applicable laws, or platform policies.

Payments on Item Instock are processed through approved third-party payment providers. Item Instock facilitates payment collection, refunds, disputes, and reversals, but does not accept or dispense cash. Seller earnings may be withdrawn via supported payout methods, subject to verification and regulatory requirements. A payment method or bank account may only be linked to one Item Instock account.

Users must comply with all Item Instock policies, including but not limited to: Prohibited Items, Prohibited Conduct, Safety Guidelines, Sales Tax Policy, Refunds & Returns Policy, DMCA/Copyright Policy, Law Enforcement Requests, and Seller & Buyer Protection rules. These policies are incorporated into and form part of these Terms.

You retain ownership of content you post on Item Instock (“Your Content”), but you grant Item Instock a worldwide, royalty-free, sublicensable license to use, display, modify, and distribute such content for operating, improving, and promoting the Service. You are responsible for ensuring Your Content does not infringe third-party rights or violate platform rules.

Item Instock provides the Service “as is” and “as available,” without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or the quality, legality, or safety of items listed by users. To the maximum extent permitted by law, Item Instock disclaims liability for indirect, incidental, or consequential damages arising from use of the Service.

Item Instock reserves the right to modify these Terms at any time by posting an updated version on the platform. Changes take effect upon posting. Continued use of the Service after updates constitutes acceptance of the revised Terms.

These Terms are governed by applicable laws of the jurisdiction in which Item Instock operates, unless otherwise required by law. Users agree to resolve disputes according to the dispute resolution procedures outlined in the Item Instock Help Center.
